Welcome to EvalAI. These Terms & Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an institution ("User", "you", or "your"), and EvalAI Technologies Pvt. Ltd. ("Company", "we", "us", or "our"), concerning your access to and use of the EvalAI platform, website, software, APIs, and services (collectively, the "Platform").
1.1 Acceptance of Terms: By registering for, accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you are prohibited from using the Platform and must discontinue use immediately.
1.2 Definitions:
2.1 Eligibility: You must be at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to bind yourself or the institution you represent to these Terms. The Platform is built primarily for educators and educational institutions.
2.2 Account Registration: To use key features of the Platform, you must register and create an account. You agree to provide accurate, current, and complete information. You are responsible for keeping your registration data updated.
2.3 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials (username, password, or API keys). You agree to accept responsibility for all activities that occur under your account. You must notify us immediately at ritik@evalai.dev of any unauthorized access or breach of security.
2.4 Suspension: We reserve the right to suspend or terminate accounts that violate these Terms, provide false details, or engage in abuse or misuse of the platform.
3.1 Acceptable Use: Users are permitted to use the Platform solely for lawful educational evaluation purposes. You may upload scanned handwritten answer sheets to perform OCR extraction, AI grading, and generate academic performance reports in accordance with these Terms.
3.2 Prohibited Activities: As a user of the Platform, you agree not to:
4.1 AI-Assisted Tool: EvalAI provides AI-assisted answer sheet evaluation using Optical Character Recognition (OCR) and machine learning models (such as Gemini 1.5 Flash). You acknowledge that these evaluations are provided as helper tools for educators and must NOT be used as the sole basis for final grading or high-stakes academic decisions.
4.2 Mandatory Educator Review: All AI-generated evaluation marks, grading recommendations, and comments MUST be reviewed, audited, and approved by qualified human educators or grading authorities before final marks are recorded or published.
4.3 Accuracy and OCR Limitations: EvalAI makes no guarantee of 100% evaluation accuracy. Grading results may be incorrect, incomplete, or corrupted due to:
4.4 Disclaimer: EvalAI is not responsible or liable for any grading discrepancies, inaccurate calculations, academic grievances, or student disputes resulting from these factors.
5.1 Ownership of Uploaded Documents: All scanned answer sheets, model answers, rubrics, and educational content uploaded by you to the Platform remain your exclusive property (or the property of your students/institution). EvalAI claims no ownership rights over your content.
5.2 License to Process: You grant us a non-exclusive, worldwide, royalty-free, limited license to process, store, transmit, and analyze your content solely for the purpose of providing, maintaining, and improving the evaluation service for you.
5.3 Permission to Upload: You represent and warrant that you possess all necessary consents, legal permissions, and licenses (from students, parents, and/or educational institutions) to upload student answer sheets and process their written answers and identifiers on the Platform.
5.4 EvalAI Intellectual Property: All materials on the Platform, including but not limited to source code, databases, website layouts, designs, algorithms, graphics, and trademarks (the "EvalAI IP"), are owned by or licensed to EvalAI Technologies Pvt. Ltd., and are protected by Indian and international intellectual property laws.
6.1 Processing Technologies: You acknowledge that the Platform utilizes Optical Character Recognition (OCR), machine learning models, third-party cloud computing servers, and LLM APIs to process, parse, and analyze uploaded answer sheets.
6.2 Security Standards: We implement industry-standard security measures, including AES-256 encryption at rest and TLS 1.3 encryption in transit, to protect student and institutional data. However, no digital transmission is 100% secure, and we cannot guarantee absolute data security.
6.3 Storage Retention: Scanned files and reports are retained for the duration specified by your subscription plan (e.g., 7 days for Free Trial, 90 days for Department). Users are responsible for exporting and downloading their marksheet reports before the storage period expires. EvalAI is not liable for data deleted post-retention.
6.4 Privacy Policy: Our data handling practices are described in detail in our Privacy Policy, which is incorporated by reference into these Terms.
7.1 Token-Based Billing: Use of the Platform requires token credits. Tokens are consumed per sheet/page evaluated. Subscriptions and token packages are billed in advance. All purchases are non-refundable unless required by applicable law.
7.2 Third-Party Services: The Platform integrates third-party APIs (including Google Vision and AI model hosts) to perform evaluations. You acknowledge that our service depends on the availability of these third-party systems. EvalAI is not responsible for outages or failures caused by third-party APIs.
7.3 Service Availability: EvalAI is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted, secure, or error-free operation. We reserve the right to modify, suspend, or perform maintenance on the Platform at any time without prior notice.
8.1 Limitation of Liability: To the maximum extent permitted by applicable Indian law, in no event shall EvalAI, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, institutional reputation, academic standings, or grading disputes) arising out of or related to your use of the Platform.
8.2 Liability Cap: Our total aggregate liability for any claims under these Terms shall be limited to the amount paid by you, if any, for using the Platform during the twelve (12) months preceding the claim.
8.3 Indemnification: You agree to indemnify, defend, and hold harmless EvalAI from and against any claims, liabilities, damages, or costs (including legal fees) arising from your violation of these Terms, misuse of the Platform, or the unauthorized upload of student personal data or copyrighted materials.
8.4 Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal action or dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad/Noida, Uttar Pradesh, India.
